End User License Agreement

Please read this End User License Agreement (“EULA”) before You purchase a License Key for the Peasy Plot App and subsequently download and use the Peasy Plot App.

By purchasing a License Key and/or downloading and using the Peasy Plot App, You agree, without reservation to be bound by the terms of this EULA. If You do not agree with the terms of this EULA, please do not purchase a License Key and/or download and use the Peasy Plot App.

If You accept the terms and conditions in this EULA on behalf of a company or other legal entity, You warrant that You have full legal authority to accept the terms and conditions in this EULA on behalf of such company or other legal entity, and to legally bind such company or other legal entity.

You may not accept this EULA if You are not of legal age to form a binding contract with Peasy Studio.

1. DEFINITIONS In this EULA the expressions below shall have the meaning assigned to them in this clause, unless the context requires otherwise:

  • “Documentation”: the detailed information about the Peasy Plot App, its features and the system requirements as made available on the website of Peasy Plot, as amended from time to time;

  • “Peasy Plot License”: the license for the Peasy Plot App for the term specified on the webpage of the store where You purchase the license, or in any applicable agreement concerning the purchase of the license to Use the Peasy Plot App;

  • “License Key”: a unique code provided by Peasy Plot via the merchant of record (Lemon Squeezy), which enables You to activate and to subsequently use the Peasy Plot App;

  • “Peasy Studio”: operated by T Williams, United Kingdom;

  • “Peasy Plot App” or “Software”: any software application and/or all of the contents of the files and/or other media, including software setup files, licensed to You by Peasy Studio, including any Updates;

  • “Updates”: any modified versions and updates of, and additions to the Peasy Plot App (excluding major upgrades of the Peasy Plot App);

  • “Use”: the access, download, install, copy or get benefit from using the Peasy Plot App in accordance with the documentation;

  • “You”: you, the final and ultimate user of the Peasy Plot App or the authorized representative of a company or other legal entity that will be the final and ultimate user of the Peasy Plot App, and the company or other legal entity that will be the final and ultimate user of the Peasy Plot App, if applicable.

2. GENERAL

2.1 This EULA applies to any licenses granted to You by Peasy Studio for the use of the Peasy Plot App.

2.2 By purchasing a License Key for the Peasy Plot App and/or downloading and using the Peasy Plot App, You enter into this EULA with Peasy Studio.

2.3 You acknowledge that this EULA may be modified from time to time without prior notice to You. Such modifications will be effective upon posting on https://www.peasyplot.com/eula/.

3. LICENSE GRANT

3.1 Subject to the terms and conditions of this EULA and to Your payment of the applicable fees, Peasy Studio grants You a non-exclusive, non-transferable, non-sublicensable, limited, revocable license to Use the Peasy Plot App in accordance with this EULA. Peasy Studio reserves all rights not expressly granted to You.

3.2 The fees displayed on Peasy Plot's pricing page are applicable for direct purchases made on peasyplot.com and may vary on third-party merchant platforms.

3.3 Peasy Studio is and remains the owner of any intellectual property rights with respect to the Peasy Plot App. You shall not acquire any ownership to the Peasy Plot App as result of Your purchase of the License Key or Your Use of the Peasy Plot App.

4. PERMITTED USE AND RESTRICTIONS

4.1 In order to be able to install the Peasy Plot App and receive Updates and upgrades, Your computer shall have access to the Internet and shall meet the system requirements described in the Documentation found on: www.peasyplot.com/systemreqs.

4.2 Trial Use: A free 30-day trial is available. You shall use the Peasy Plot App on one device using a trial license key. The trial usage of the Peasy Plot App is still subject to the terms of this EULA.

4.3 Standard Installation Limits: Unless You have purchased a separate specific license type (see Section 5), You shall Use the Peasy Plot App on up to two computers only. If You exceed the limit, or share the License Key, Peasy Studio may block the License Key in accordance with clause 10.3 of this EULA.

4.4 You shall Use the Peasy Plot App in accordance with applicable laws and shall not:  

  • a) rent, lease, lend, sell, redistribute, sublicense or otherwise commercially exploit the License Key;

  • b) assign the License Key or the Peasy Plot License without prior written approval of Peasy Studio;

  • c) use the Peasy Plot App for any unlawful or illegal activity;

  • d) delete or alter any disclaimers, warnings, copyright or other proprietary notices accompanying the Peasy Plot App;

  • e) copy (except as otherwise provided in this EULA), adapt, translate, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the Peasy Plot App and the License Key or any parts thereof, except to the extent permitted by applicable law.

4.5 Peasy Studio may modify the Peasy Plot App at any time at its sole discretion and without notice to You, for example to comply with applicable law or a court order, to avoid a third party infringement claim or to provide Updates and upgrades.

5. SPECIFIC LICENSE TYPES

5.1 School Licences: These are granted for educational use within the purchasing school only. Sharing the licence key outside the school (including personal use by staff, students, or family) is not permitted and may result in deactivation.

5.2 Team and Office Licences: These are granted solely for use within the purchasing organisation (including its employees and contractors working on behalf of the organisation). The licence key may be installed and activated on the number of devices specified at purchase (or unlimited, as applicable), provided all use remains internal to the organisation’s business operations. The licence key must not be shared, distributed, or used outside the purchasing organisation. Any unauthorised use or sharing may result in immediate deactivation of the licence key, revocation of access, and potential re-invoicing at the full individual licence rate for each unauthorised user/device. We reserve the right to request reasonable proof of use to ensure compliance.

6. UPDATES AND SUPPORT POLICY

6.1 General: Peasy Studio may from time to time provide updates, upgrades, bug fixes, patches, or other modifications to the Software ("Updates"). Peasy Studio is under no obligation to develop or release any Updates.

6.2 Scope of Licenses:

  • Subscription Licenses: If You hold an active subscription, You are entitled to all available Updates for the duration of Your subscription.

  • Lifetime Licenses: A "Lifetime" license grants You perpetual rights to use the specific Major Version purchased (e.g., version 26.x.x) indefinitely. You are entitled to all Minor Updates (bug fixes and improvements) released within that specific Major Version cycle at no additional cost. ​

6.3 End of Life Policy: Peasy Studio does not maintain indefinite support for older software versions. Active support and Updates are provided only for the current Major Version of the Software. Critical security or stability fixes may, at Peasy Studio’s sole discretion, be provided for the immediately preceding Major Version. Once a version becomes two Major Versions older than the current available version, it reaches "End of Life" status and will no longer receive any Updates or active support.

6.4 Technical Support: Any technical support provided by Peasy Studio, including the provision of Updates and upgrades, will be provided in an adequate way on an “as is” basis without any warranty, as soon as reasonably practicable, subject to availability of personnel. You may need to pay an additional fee in order to be able to download a major upgrade.

7. REFUNDS AND CANCELLATION

7.1 Digital content such as the Peasy Plot App is provided immediately upon purchase and delivery of the License Key. By purchasing, downloading, or activating the Peasy Plot App, You explicitly consent to immediate performance of this EULA and acknowledge that You waive any right to withdraw from or cancel the purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or equivalent laws.

7.2 Notwithstanding the foregoing, Peasy Studio may offer a separate, discretionary guarantee policy on its website. Except as expressly provided in such a policy, or where required by applicable law (e.g., for faulty products under the Consumer Rights Act 2015), refunds are not generally available after activation of the License Key.

7.3 All payments are processed by our merchant of record, Lemon Squeezy, whose terms may apply.

8. USE OF DATA

8.1 Peasy Studio may periodically collect and use technical and related data concerning the Peasy Plot App You have licensed, including about the version number installed and about the system You have installed it on. Peasy Studio will use such data to facilitate maintenance and support, to improve its products and to provide further services to You.

8.2 Peasy Studio may process personal data with respect to You, if and to the extent necessary to provide the License Key, to provide maintenance and support, and to comply with its obligations under this EULA. Please see our privacy statement for more details on the processing of Your personal data.

9. DISCLAIMER

YOU USE THE PEASY PLOT APP AT YOUR OWN RISK. THE PEASY PLOT APP AND ACCOMPANYING DOCUMENTATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY - EXPRESS OR IMPLIED - OF ANY KIND, AND PEASY STUDIO SPECIFICALLY DISCLAIMS THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. NO ORAL OR WRITTEN ADVICE GIVEN BY PEASY STUDIO SHALL CREATE A WARRANTY.

10. LIABILITY LIMITATION

10.1 The liability of Peasy Studio for all damages arising out of or in any way relating to this EULA shall in no event exceed the total amount(s) paid by You to Peasy Studio in the preceding billing period.

10.2 Peasy Studio is under no circumstances liable for consequential or indirect damages (including damage for loss of profit, business interruption, loss of data, and the like arising out of the use or inability to use the Peasy Plot App).

10.3 The limitations of liability referred to in clause 10.1 and 10.2 shall not apply in the event that damages arise from the intent, willful misconduct or gross negligence of Peasy Studio. Nothing in this EULA excludes or limits liability for death/personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. TERMINATION

11.1 This EULA will continue to be in force until the expiry or termination of the Peasy Plot License.

11.2 The Peasy Plot License will terminate automatically at the end of the applicable license term, unless renewed.

11.3 Peasy Studio is entitled to terminate the Peasy Plot License by blocking the License Key with immediate effect in the event You fail to comply with the terms in this EULA.

11.4 Upon termination, You shall cease all use of the Peasy Plot App.

12. GOVERNING LAW AND DISPUTES

This EULA shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute between Peasy Studio and You shall exclusively be submitted to the competent court within the United Kingdom.
